On February 27, FinCEN announced a temporary suspension of CTA enforcement action and indicated that compliance deadlines would be re-set through an interim final rule to be published on or before March 21.
On March 2, the Treasury Department took this a step further by announcing that “[Treasury] will further not enforce any penalties or fines against U.S. citizens or domestic reporting companies or their beneficial owners after the forthcoming rule changes take effect either.” Signaling a significant shift in BOI reporting under the CTA, Treasury committed to “issuing a proposed rulemaking that will narrow the scope of the [BOI] rule to foreign reporting companies only.” No further details were released. Varnum’s CTA Taskforce continues to monitor these developments and will provide updates as they become available.
